This Privacy Policy explains what personal information MadeCentz LLC ("Company," "we," "us") collects through the MadeCentz website and mobile application (the "Platform"), why we collect it, who we share it with, and the choices and rights available to you. This Policy covers general personal information; biometric identifiers collected during identity verification and mobile app device permissions are covered in more detail in the separate Biometric Data, Privacy & App Permissions Policy, which is incorporated by reference.
1. Scope
This Policy applies to Create Users and Earn Users of the Platform (together, "Users," "you"). The Platform currently operates in the United States only. If you access the Platform from outside the United States, your information will be processed in the United States, and this Policy is written around U.S. law; it does not currently address GDPR, UK, or other non-U.S. privacy regimes.
2. Categories of Personal Information We Collect
- Identifiers: name, email address, phone number, account username, and device/browser identifiers.
- Government ID and verification data: processed through the Payment Processor's identity verification service; see the Biometric Data, Privacy & App Permissions Policy for what the Company itself retains (limited to a state code) versus what stays with the Payment Processor.
- Profile information you provide: self-reported date of birth, self-reported state of residency, profile photo, bio, uploaded degrees/certifications/licenses.
- Payment and tax information: processed through the Payment Processor (Stripe), including bank account details for ACH, Form W-9 information, and payment card details. The Company does not store full card numbers or complete bank account numbers.
- Job and transaction data: job postings, applications, job history, messages between Users related to a Job, dispute and report records, ratings and reviews.
- Location data: the state associated with your verified identity, the location you provide for a Job posting, and, on mobile, precise device location if you grant that permission (see the Biometric Data, Privacy & App Permissions Policy for permission details).
- Device and usage data: IP address, browser type, operating system, pages viewed, and similar analytics data collected automatically when you use the Platform.
- Communications: messages you send to Company support, and records of your acknowledgments of the click-through disclosures presented at various points in the Platform.
3. How We Use Personal Information
- To create and administer your account and operate the marketplace, including matching Create Users and Earn Users.
- To verify identity and apply minimum-age and state-specific eligibility rules described in the Terms of Service, including reconciling self-reported information against verified identity data.
- To process payments, payouts, tax reporting, and related financial functions through the Payment Processor.
- To investigate reports and disputes between Users, and to determine whether to release, hold, or refund payments under the Terms of Service.
- For fraud prevention, security, and to enforce the Terms of Service, including detecting location or identity misrepresentation.
- To comply with legal obligations, including tax reporting and responding to law enforcement requests as described in the Terms of Service.
- To provide customer support and respond to inquiries.
- To send you service-related communications (job matches, payment notifications, dispute updates). Marketing communications, if any, will include an opt-out mechanism.
4. How We Share Personal Information
- With the Payment Processor (Stripe), to provide identity verification, payment processing, payout, and tax-reporting functionality.
- With other Users, limited to what is reasonably necessary to complete a Job: profile information, job-relevant communications, and — in a dispute — the records described in the Terms of Service Section 11. We do not share your government ID, biometric data, or full payment/banking details with other Users.
- With third-party service providers who perform functions on our behalf, such as cloud hosting, analytics, and (if you choose to use one) an optional third-party insurance product as described in the Terms of Service Section 8.1. Service providers are contractually restricted from using your information for their own purposes.
- With law enforcement or other parties when required by valid legal process, or as described in the Terms of Service Section 11.1.
- In connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.
- We do not sell personal information for money. Depending on your state of residence, certain sharing arrangements described above (for example, with analytics or advertising-related service providers, if used) may be defined as a "sale" or "share" under state law even without a monetary exchange; see Section 7 for your opt-out rights.
5. Cookies and Tracking Technologies
- The Platform uses cookies and similar technologies for: (a) essential functionality (keeping you logged in, security); (b) analytics, to understand how the Platform is used; and (c) if applicable, advertising measurement.
- You can control cookies through your browser settings. The Platform will honor the Global Privacy Control (GPC) signal and other recognized universal opt-out mechanisms as an opt-out of sale/sharing and targeted advertising, where required by applicable state law.
- The Platform does not currently respond to browser "Do Not Track" signals separately from GPC, since there is no common industry standard for DNT.
6. Data Retention
We retain personal information for as long as your account is active, and for a limited period afterward as needed to comply with legal obligations (including tax record-keeping), resolve disputes, enforce our agreements, and maintain security records. Biometric data retention is addressed separately and more specifically in the Biometric Data, Privacy & App Permissions Policy. When information is no longer needed for these purposes, we take reasonable steps to delete or de-identify it.
7. Your Privacy Rights
A number of U.S. states now provide residents with statutory privacy rights (including, among others, California, Colorado, Connecticut, Virginia, and a growing list of other states), each with its own specific thresholds and requirements. Rather than offer different rights to residents of different states, the Company offers the following baseline rights to all U.S. Users, regardless of your state of residence:
- Right to know / access: request a copy of the categories and specific pieces of personal information we hold about you.
- Right to correct: request correction of inaccurate personal information.
- Right to delete: request deletion of your personal information, subject to exceptions such as information we are required to retain for legal, tax, or security purposes, or to complete a transaction already in progress.
- Right to opt out of sale/sharing and targeted advertising: as described in Section 5, including via Global Privacy Control.
- Right to limit use of sensitive personal information: where applicable, you may request that we limit use of sensitive categories (such as government ID data) to what is necessary to provide the Platform.
- Right to non-discrimination: we will not deny you service, charge you a different price, or provide a different level of service because you exercised a privacy right.
- Right to appeal: if we deny a rights request, you may appeal by contacting us at the address in Section 13; if the appeal is also denied, we will provide information on further options available under your state's law, if any.
To exercise a right, contact us using the information in Section 13 and include: your name, the email or phone number on your account, and a description of the right you are exercising. We do not require your home address to process a rights request. We will verify your identity before fulfilling a request using the information already on your account, and will respond within the time period required by applicable law (generally within 45 days, which may be extended once by an additional 45 days with notice to you).
Nevada residents: Nevada's privacy law (NRS Chapter 603A) gives Nevada residents a right to opt out of the sale of certain covered information for monetary consideration. The Company does not sell personal information for monetary consideration, and in any event, the opt-out and other rights described above are already offered to Nevada residents as part of the national baseline in this Section.
8. Sensitive Personal Information
Certain information we process is treated as "sensitive" under one or more state privacy laws, including government ID numbers, biometric identifiers (see the Biometric Data, Privacy & App Permissions Policy), and precise geolocation (if you grant that device permission). We use sensitive personal information only for the specific purposes disclosed in this Policy and the Biometric Data, Privacy & App Permissions Policy — principally identity verification, eligibility determination, and fraud prevention — and do not sell it.
9. Children's Privacy
The Platform is not directed to, and is not intended for use by, anyone under the minimum age described in the Terms of Service Section 3. We do not knowingly collect personal information from anyone below that age. If we learn that we have done so, we will take steps to delete that information and close the associated account.
10. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No system is completely secure, and we cannot guarantee the absolute security of your information. In the event of a security incident affecting your personal information, we will notify you and any applicable regulators as required by applicable state breach-notification law.
11. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be notified through the Platform or by email. Continued use of the Platform after a change takes effect constitutes acceptance of the updated Policy.
